1. Acceptance of these Terms

These Terms of Service ("Terms") form a legally binding agreement between you and the operator of Second Hand ("we", "us", or "the operator"). By accessing, browsing, creating an account on, or posting any content to Second Hand, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use Second Hand.

2. Nature of the service

Second Hand is an online classifieds platform that lets users post and browse listings and contact one another. We are a neutral venue only. We do not own, sell, buy, inspect, store, ship, or take possession of any item listed, and we are not a broker, agent, auctioneer, or party to any dealing between users. Any contract for a sale, rental, service, or other transaction is made solely between the users involved and at their own risk.

3. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into contracts to use Second Hand. You are responsible for the accuracy of your registration details, for keeping your password confidential, and for all activity under your account. You agree to notify us immediately of any unauthorised use. We may refuse, suspend, or terminate any account at our sole discretion.

4. User conduct

You agree not to use Second Hand to post false, misleading, fraudulent, defamatory, harassing, obscene, or unlawful content; to infringe any third party's intellectual-property, privacy, or other rights; to send spam, scrape or harvest data, or interfere with the operation or security of the site; to impersonate any person; or to violate any applicable law or regulation. You are solely responsible for all content you submit and for your interactions with other users.

5. Prohibited and restricted items

You may not list or attempt to trade any item or service whose sale, possession, or advertisement is illegal or restricted in the applicable jurisdiction — including, without limitation, weapons, drugs, stolen or counterfeit goods, hazardous materials, live animals where prohibited, recalled products, and any regulated goods you are not licensed to sell. We may remove any listing and report unlawful activity to the authorities.

6. Your content and the licence you grant

You retain ownership of the content you post, but you grant the operator a worldwide, non-exclusive, royalty-free, transferable, sub-licensable licence to host, store, display, reproduce, and distribute that content for the purpose of operating, promoting, and improving Second Hand. You represent and warrant that you own or have all rights necessary to post your content and that it does not violate these Terms or any law.

7. Transactions are solely between users

Because we are not a party to any transaction, we make no representations about, and accept no responsibility for, the existence, quality, safety, legality, or accuracy of any item or listing, the truth or accuracy of any listing, the ability of sellers to sell, or the ability of buyers to pay. All negotiations, payments, deliveries, returns, refunds, and disputes are handled directly between users. We have no obligation to become involved in any dispute, but may do so at our discretion without thereby assuming any liability.

8. Assumption of risk and safety

You use Second Hand and deal with other users entirely at your own risk. Meet in safe, public places, verify goods before paying, and exercise caution with strangers and with any payment method. You assume all risks associated with any interaction, communication, meeting, or transaction arising from your use of the site.

9. Disclaimer of warranties

Second Hand is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, timely, error-free, or free of viruses or other harmful components, or that any defect will be corrected. No advice or information, whether oral or written, obtained from us or through the site creates any warranty not expressly stated in these Terms.

10. Limitation of liability

To the maximum extent permitted by law, the operator and its owners, contributors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of (or inability to use) Second Hand, any transaction or interaction with another user, or any content on the site — whether based in contract, tort, negligence, strict liability, or any other theory, and even if we have been advised of the possibility of such damages. To the extent any liability cannot lawfully be excluded, our total aggregate liability for all claims shall not exceed the greater of the total amount you paid us (if any) to use the service in the twelve months before the event giving rise to the claim, or one hundred US dollars (USD 100).

11. Indemnification

You agree to defend, indemnify, and hold harmless the operator and its owners, contributors, and agents from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your content, your use of Second Hand, your transactions or dealings with other users, or your breach of these Terms or of any law or third-party right.

12. Release of the operator

Because the operator is only a venue, if you have a dispute with one or more users you release the operator and its owners, contributors, and agents from any and all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. You expressly waive any statutory or other legal protection that would otherwise limit the coverage of this release to claims you know or suspect to exist in your favour at the time of agreeing to these Terms.

13. Third-party services and links

Second Hand may rely on or link to third-party services and websites that we do not control. We are not responsible for their content, policies, availability, or practices; your use of them is at your own risk and subject to their own terms.

14. Intellectual property

The software, design, layout, text, graphics, and other materials of Second Hand (excluding user content) are owned by the operator and protected by applicable law. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the site except as expressly permitted by us in writing.

15. Privacy

Your use of Second Hand is also governed by our Privacy Policy, which describes what information we collect and how we use it. By using the site you consent to that processing.

16. Suspension and termination

We may modify, suspend, or discontinue any part of Second Hand, and may suspend or terminate your account or remove any content, at any time, with or without notice, for any reason, including a suspected violation of these Terms. Provisions that by their nature should survive termination — including the disclaimers, limitation of liability, indemnification, and release — will survive.

17. Changes to the service and to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page with an updated date. Your continued use of Second Hand after changes are posted constitutes acceptance of the revised Terms.

18. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which the operator of Second Hand is established, without regard to its conflict-of-law rules. You agree that the competent courts of that jurisdiction shall have exclusive jurisdiction over any dispute not otherwise resolved, and you waive any objection to venue there. Any claim you may have arising out of these Terms or the service must be commenced within one (1) year after the claim arises, otherwise it is permanently barred.

19. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them freely. These Terms are the entire agreement between you and us regarding Second Hand and supersede any prior understanding. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
